Das KfW-Bildarchiv sowie das darin enthaltene Material sind dazu bestimmt, die Öffentlichkeit über Geschäftsbereiche und Projekte der KfW zu informieren und gleichzeitig Redakteuren durch den unentgeltlichen Zugriff auf das Bild- und Informationsmaterial die Bildrecherche und Berichterstattung zu erleichtern. Die hier eingestellten Fotografien sind urheberrechtlich geschützt. Mit Ihrer Einverständniserklärung erkennen Sie die nachstehenden Nutzungsbedingungen des KfW-Bildarchivs an: 1. Nutzung des Bildmaterials zu Zwecken der öffentlichen Berichterstattung Journalisten, Redakteure, Verlage und Presseunternehmen sind unter Berücksichtigung der folgenden fünf Bedingungen berechtigt, Bildmaterial aus dem Bildarchiv der KfW Bankengruppe zu nutzen: a. Die Vervielfältigung, Verbreitung, öffentliche Zugänglichmachung, Sendung oder sonstige Nutzung erfolgt ausschließlich zu Zwecken der Öffentlichkeitsinformation und Berichterstattung, insbesondere in unmittelbarem Zusammenhang mit Aktivitäten der KfW Bankengruppe. b. Bei jeder Veröffentlichung ist ein Copyright-Vermerk zu nennen. Er hat aus der Angabe der Quelle "KfW-Bildarchiv" zu bestehen und ist, soweit dort genannt, zusätzlich mit der Angabe des Vor- und Nachnamens des Fotografen / der Fotografin oder der Angabe der Firma der Fotoagentur zu versehen. Der jeweilige Copyright-Vermerk ist den Bildinformationen zu entnehmen. c. Die Nutzung von Bildausschnitten, eine Bearbeitung oder sonstige Umgestaltung der Fotografien, insbesondere durch Verfremdung, Kolorierung, Fotomontage oder Foto-Composing sowie jedwede Entstellung sind unzulässig. Zulässig ist die Veröffentlichung von Farbfotografien in schwarz-weiß sowie das Erstellen von Bildausschnitten, die die Bildaussage nicht verfremden. Eine Nutzung des Bildmaterials auf Social Media-Plattformen ist nur gestattet, wenn sie in den Bildinformationen nicht ausgeschlossen wird. d. Der Nutzer ist nicht berechtigt, von ihm abgerufene Bilddateien an Dritte weiterzugeben. e. Die Nutzungsberechtigung erlischt, wenn und sobald eine Fotografie von der KfW aus dem Archiv genommen wird. Die Nutzung des KfW-Bildarchivs zu diesen Bedingungen ist unentgeltlich und von keiner Gegenleistung abhängig. Sonstige Nutzung Jedwede sonstige, über die bloße Inaugenscheinnahme des Bildmaterials und die damit zwangsläufig verbundenen Nutzungshandlungen hinausgehende Nutzung ist nur gestattet, wenn und soweit sie nach den Bestimmungen des deutschen Urheberrechtsgesetzes in der zum Zeitpunkt der Nutzung geltenden Fassung zulässig ist. Eine Nutzung zu gewerblichen Zwecken ist stets unzulässig, soweit sie nicht nach Ziffer 1 gestattet ist. 3. Gewährleistung/Haftung a. Für Sach- und Rechtsmängel, insbesondere die Bildqualität, die Aktualität und Authentizität des Bildmaterials, die Abrufbarkeit und die einwandfreie Übertragung des Bildmaterials und der Bilddateien übernimmt die KfW keine Gewährleistung. Schadensersatzansprüche des Nutzers bleiben unberührt, soweit sie nicht nach lit. c) ausgeschlossen sind. b. Der KfW ist es zu jeder Zeit unbenommen, das Bildarchiv und/oder eingestellte Bildmaterialien ohne Vorankündigung und ohne Angabe von Gründen zu verändern und ganz oder teilweise nicht mehr bereit zu stellen. c. Die Haftung der KfW, ihrer Organe und Mitarbeiter sowie der Fotografen und Bildlieferanten, gleich aus welchem Rechtsgrund, ist ausgeschlossen. Dies gilt nicht bei Vorsatz oder grober Fahrlässigkeit oder im Fall der Verletzung vertragswesentlicher Pflichten. Im Falle der leicht fahrlässigen Verletzung vertragswesentlicher Pflichten haften wir nur bis zur Höhe von 1.000,- Euro. Unsere Haftung bei Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach zwingenden, gesetzlichen Vorschriften, insbesondere des Produkthaftungsgesetzes, bleibt unberührt. 4. Anzuwendendes Recht, Gerichtsstand a. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland. b. Ist der Nutzer Kaufmann oder hat er keinen allgemeinen Gerichtsstand in Deutschland, so ist sein Gerichtsstand Frankfurt am Main. Wir sind jedoch berechtigt, den Nutzer auch an seinem allgemeinen Gerichtsstand zu belangen.

The KfW Photo Archive as well as the photographs contained therein serve the purpose of informing the public about KfW’s business areas and projects while, at the same time, assisting editors by offering them cost-free access to photographs and information materials in order to facilitate their search for photographs and their reporting. The photographs available in the Archive are subject to copyright. By declaring your consent, you agree to the following terms and conditions of use of the KfW Photo Archive: 1. Use of the photographs for public reporting purposes Journalists, editors, publishing houses and press companies are entitled to use photographs taken from the Photo Archive of the KfW Group, provided that they observe the five conditions below: a. The reproduction, dissemination, public disclosure, broadcast or other use of Archive content will solely be for the purpose of public information and reporting, especially in direct connection with KfW Group’s activities. b. Every time a photograph is published, a copyright notice has to be included. The source ‘KfW Photo Archive’ and, if stated therein, first and surname of the photographer or the name of the photo agency are to be indicated. The respective copyright notice can be found in the photo information. c. The use only of certain details of a photograph, the modification or other type of alteration of a photograph, in particular via content manipulation, coloration, photomontage or photo composing as well as misrepresentation by any other means is not allowed. However, publication of color photographs as black/white photographs as well as cropping of images is allowed, as far as this does not distort their meaning. Use of the image material on social media platforms is only permitted if it is not excluded in the image information.". d. Users are not authorised to pass on downloaded photographs to a third party. e. The right of use expires if and as soon as KfW removes a photograph from the Archive. The use of the KfW Photo Archive under these terms and conditions is free of charge and does not require any consideration in return. Other use Any other use beyond simple inspection of the photographs and the connected actions related to their use is only allowed if and to the extent that it is admissible in accordance with the provisions set forth in German copyright law in the version prevailing at the time of such use. Use for commercial purposes is never allowed unless an exception is made pursuant to Section 1). 3. Guarantee/liability KfW does not give any guarantees for material defects and legal deficiencies, in particular regarding the quality, timeliness and authenticity of the photographs, the retrievability and smooth transmission of the photographs and photo files. User claims for indemnification will remain unaffected insofar as they are not excluded pursuant to paragraph c). b. KfW is free to, at any time, change the Photo Archive and/or photographs it has placed therein without prior announcement and without stating any reasons. KfW may also decide to cease offering the Photo Archive in full or in part. c. KfW, its organs and employees, as well as the photographers and suppliers of photographs are exempt from liability, regardless of the legal reason. This does not apply in the event of wilful intent or gross negligence, or in the event of a breach of fundamental contractual obligations. In the event of a slightly negligent breach of fundamental contractual obligations KfW may be held liable to a maximum amount of EUR 1,000. Our liability for damages resulting from injury to life, body or health, also pursuant to peremptory statutory provisions, in particular the German Product Liability Act, will remain unaffected. 4. Applicable law, place of jurisdiction a. These terms and conditions are governed solely by the laws of the Federal Republic of Germany. b. If a user is a businessperson (‘Kaufmann’) under German law, or if he/she does not have a general place of jurisdiction in Germany, the place of jurisdiction will be Frankfurt am Main. KfW is, however, also entitled to prosecute a user in his/her general place of jurisdiction.
